TALENT AGENCY AGREEMENT
This Agreement is entered into between Prairie Casting Agency (hereinafter referred to as the "Agency") and ____ (hereinafter referred to as the "Talent").
1. Services
The Talent hereby engages Prairie Casting Agency as their exclusive agent for the purpose of securing employment and engagements in the entertainment industry, including but not limited to acting, voice-over, commercial, film, television, theatre, and related fields. The Agency agrees to use reasonable efforts to procure such employment opportunities on behalf of the Talent.
2. Territory
The Agency shall act as the exclusive representative of the Talent within the province of Saskatchewan. The Agency may also pursue opportunities outside of Saskatchewan on behalf of the Talent, subject to mutual agreement between the parties.
3. Agreement Term
This Agreement shall be effective for a period of one (1) year from the date of execution. This Agreement shall automatically renew for successive one (1) year periods unless either party provides written notice of termination at least thirty (30) days prior to the end of the current term. Either party may terminate this Agreement at any time by providing thirty (30) days written notice to the other party.
4. Talent Duties
The Talent agrees to the following obligations:
- Maintain an up-to-date profile, including current headshots, contact information, measurements, and skills, with the Agency at all times.
- Notify the Agency promptly of any changes to availability, contact information, appearance, or other relevant details.
- Conduct themselves in a professional manner at all auditions, bookings, and related engagements secured through the Agency.
- Attend all confirmed auditions and bookings on time and fully prepared, unless prevented by illness or emergency, in which case the Talent shall notify the Agency as soon as reasonably possible.
- Not engage or accept employment in the entertainment industry within the Territory through any other agent or representative without the prior written consent of the Agency.
- Promptly inform the Agency of any employment opportunities or offers received directly by the Talent within the Territory.
5. Talent Authorization
The Talent hereby authorizes Prairie Casting Agency to use their name, likeness, photographs, biographical information, and performance materials for the purpose of promoting the Talent and securing employment opportunities. This authorization extends to the Agency's website, social media accounts, promotional materials, and submissions to casting directors, producers, and other industry professionals.
6. Commission Payment
The Talent agrees to pay Prairie Casting Agency a commission of fifteen percent (15%) of the Talent's gross earnings for all engagements procured by the Agency. Commission payments are due within thirty (30) days of the Talent receiving payment for any such engagement. The Agency's commission shall apply to all earnings resulting from engagements secured during the term of this Agreement, including residuals, renewals, and extensions, even if payment is received after the termination of this Agreement.
7. General
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to the subject matter herein. No modification or amendment of this Agreement shall be binding unless made in writing and signed by both parties. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement may not be assigned by the Talent without the prior written consent of the Agency.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the applicable federal laws of Canada. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the Province of Saskatchewan.
9. Guardian Authorization (for talent under 18)
If the Talent is under the age of eighteen (18) years, this Agreement must be co-signed by a parent or legal guardian. The undersigned parent/legal guardian hereby consents to the terms of this Agreement on behalf of the Talent, authorizes Prairie Casting Agency to represent the Talent as described herein, and agrees to ensure the Talent's compliance with the obligations set forth in this Agreement. The parent/legal guardian must provide valid government-issued photo identification for verification purposes.
